OUTCOME: Established father's parental rights, sole cutosdy and sole decision making power for the children, limited and restricted visits for the mother and child support from the mother to the father.
The mother and father were in a relationship, on and off, for 7 years. They were not legally married, but had 2 children together. The mother had begun to seek child support through the child support... enforcement division agency. The father hired me, because the mother was not being truthful. The children lived with him, even the mother continued to live with him on and off. He was concerned about the welfare of the children because of the mother's erratic behavior. We moved the case out of the child support division and into the family division and sought sole parental responsibility and decision making for the children for the father, limited and supervised visits between the mother and the children, and child support to be calculated accordingly. As a result of the evidence in this case, we were able to get my client his full parental rights as the father in a paternity action and also we were able to demonstrate that the mother lacked the ability of caring for the children and the father was awarded sole decision making and custody. The mother has restricted and supervised visits with the children and child support was calculated and the mother has an amount she pays the father. Not all cases have the same outcome, but there was enough evidence presented over time to demonstrate what was best for the children at that time. Miami-Dade case
