Writ of Habeas Corpus Granted

My client was illegally being held pursuant to court order. I Petitioned the District Court of Appeal for a Writ of Habeas Corpus to obtain her release. The District Court of Appeal ruled in our favor ... and released the client. Following the trial court's grant of a petition for renewal of a patient's involuntary substance abuse treatment under the Marchman Act, that was filed less than ten days prior to the expiration of the treatment period, we petitioned the District Court for a Habeas Corpus directing the treatment facility for immediate release. The Fifth District Court of Appeal held that the petition for renewal is timely only if filed at least ten days before the expiration of the original treatment period. Lund v. Project Warm, 177 So.3d 238 (Fla. 5th DCA 2015).
