Serbousek v. Lucas, 191 So. 3d 539 (Fla. 5th DCA 2016)
May 20, 2016OUTCOME: Affirmed in part, reversed in part, and remanded.
HOLDINGS: [1]-Because it found the testimony of neither party credible as to the amount of the wife's need for alimony or the husband's ability to pay, the trial court properly relied on the experts' t ... estimony regarding the amount of business revenue at the time of trial to determine the need for, and ability to pay, alimony; [2]-The trial court erred in failing to directly address the wife's claim for retroactive alimony; [3]-Because the trial court distributed the couple's credit-card debts as marital debt without a finding on the value thereof, the court could not determine whether the trial court effectuated its stated intent to distribute the marital assets equally; [4]-The trial court properly denied the wife's request for attorney's fees, as it divided the marital assets roughly equally between the parties and awarded the wife alimony to equalize their financial positions.
