OUTCOME: Contract claims against my client were dismissed

A large corporate giant filed breach of contract claims against my client, the owner of a small business, among other claims. The claims were worth in excess of $1 million. I filed a motion for summa ... ry judgment, because there was no dispute of fact that the owner had not signed the contracts at issue in his personal capacity. The court agreed and granted that portion of the motion and dismissed the contract claims against the owner.

OUTCOME: Federal securities fraud claims against my clients were dismissed

A group of individuals who made capital contributions to my client, a start-up media broadcast network, filed federal securities fraud claims against the network, and its managing member, alleging that ... the company and its managing member had made fraudulent misrepresentations to induce them to contribute funds to the company. I filed a motion to dismiss those claims and argued, among other things, that these claims failed to provide any particularity concerning a principal requirement -- scienter -- for a federal securities fraud claim. The court agreed, granted that portion of the motion to dismiss and dismissed those claims for failure to plead a valid claim for relief, and ultimately dismissed the remaining claims for lack of jurisdiction.
