OUTCOME: Plaintiff’s verdict finding the Defendant 85% at fault.
This was a negligence case against Event Services America. Mr. Glorioso was leaving the Bank Atlantic Center (now BB&T Center) following a Florida panthers Hockey Game. He was leaving with cans of s...oda he had purchased from the suite level where he and his family had been sitting that night. At the end of the evening, Mr. Glorioso took the unconsumed closed cans of soda; which he had purchased, from the suite in a plastic bag. As they were leaving the stadium, he was told by an event services staff member, employed by the Defendant, ESA, that he could not take the sodas he had paid for out of the stadium. Having had paid for the sodas, he didn't agree he simply had to leave them behind and left the stadium. He exited the stadium with the bag of unopened cans of sodas in his hand. Unbeknownst to him, the ESA employee followed behind him, and without warning, from behind she yanked the bag away causing serious injury to his shoulder.
