On December 17, 2006, Paola Penafiel, was killed when her vehicle was rear ended while waiting to pay a toll on State Road 112 in Miami. Ms. Penafiel’s family retained Attorney Mark A. Glassman to pu ... rsue the driver who caused the accident. The negligent driver was insured under a $10,000 bodily injury policy with GEICO. However, GEICO withdrew its coverage and abandoned its insurer citing a legal technicality. Despite GEICO’s actions, Attorney Mark A. Glassman pursued the negligent driver and secured a $5,000,000 judgment on behalf of Ms. Penafiel’s family. Thereafter, Attorney Mark A. Glassman initiated a bad faith lawsuit against GEICO seeking to recover the full amount of the judgment against the insurance company. On February 7, 2013, after 6 years, four trials and an appeal which involved the 11th Circuit Court of Appeals and the Florida Supreme Court, a federal court jury awarded Ms. Penafiel’s family the full $5,000,000 plus interest.
