In this case involving the intersection of computer technology, the Internet, and music listening, Recording Industry Association of America and the Alliance of Artists and Recording Companies (collect ... ively, “RIAA”) sought to enjoin the manufacture and distribution by our client, Diamond Multimedia Systems (“Diamond”) of the Rio portable music player - the first mp3 player to come to market. The question was whether the Rio portable music player is a digital audio recording device subject to the restrictions of the Audio Home Recording Act of 1992.
