In this breach of contract action based upon the failure to close on a purchase of real property, we successfully recovered a majority of our client's down payment after being awarded summary judgment. ... Both sides moved for summary judgment after the matter was placed onto the Court's trial calendar. Hon. Carolyn Demarest issued a decision in favor of our client entitling her to the full return of her $210,000.00 down payment in addition to costs and attorney's fees. The matter settled after judgment was entered against Chana & Devorah but before an appeal was heard.
