Engaged in motion practice seeking to dismiss all charges pending against my client on the basis of a jurisdictional defect.

OUTCOME: Disorderly Conduct, Time Served, Conditional Discharge, Full Order of Protection, fine and surcharge.

Prior to my representation, client was charged with and arraigned on an assault 2 based upon allegations reported by witnesses, a 911 call and the victim that client intentionally struck the victim in ... the head with the blade of a machete. Photographs and evidence recovered supported allegation. Bail set at $10,000 cash/$20,000 bond. Bail reduced at my first appearance and upon my application to $5,000/$10,000. Client was able to post bond and assist more fully in his defense. After extensive investigation, discussions with victim and character witnesses, as well as significant negotiations with prosecution to point out obvious and potential flaws in the People's case, the matter was resolved with a violation level (non-criminal offense) in less than 2 months.

Client falsely accused by ex-girlfriend of violating Family Court full order of protection by emailing and/or texting her offensive/threatening messages. NY Mandatory arrest laws resulted in immediate ... arrest of client. Our investigation revealed the ex-girlfriend had been hacking into client's accounts and creating fake accounts in client's name to send messages to herself. The case was ultimately dismissed against my client and the ex-girlfriend is now charged with carious crimes.

Drug Case - Sale/Possession - Potential Life Sentence

OUTCOME: Possible life sentence resolved with sentence to what was the equivalent of time served, no post-release supervision and client retained his right to appeal.

Client indicted on 5 class B drug felonies alleged to have occurred on 3 separate dates. Client's prior criminal history made him a discretionary persistent felony which could have subjected him to the ... possibility of a maximum sentence of life in prison if convicted of even one of the 5 felonies with which was indicted. I assumed the case in March 2018 from the public defender's office who had represented my client for approximately 16 months at that point. I immediately retained the services of a private investigator to interview witnesses and develop information not available through traditional discovery/disclosure mechanisms. We conducted several hearings litigating multiple issues and a prejudicial error in District Attorney's case was disclosed. In September 2018, my client entered a plea of guilty to one (1) reduced felony and was sentenced to what was the equivalent of a time served sentence with no post-release supervision and he was able to retain his right to appeal.
