Argued before the California Court of Appeal, the issue was whether an insurance company has a right to rescind a workers' compensation policy for material misrepresentation. The Arbitrator, being uphe ... ld by the WCAB found that rescission was not available in workers' compensation. The Court of Appeal annulled the decision and did rule in favor of rescission as an available remedy in workers compensations misrepresentations.
