May 03, 2013OUTCOME: Our client is a free man.
Our client came to us after he was convicted of serious charges resulting in over a decade of prison time. We discovered that his conviction was tainted by strong evidence of prosecutorial misconduct a ... nd ineffective assistance of counsel. We appealed the conviction to the Third District Court of Appeal. Thereafter, we brought a Writ of Habeas Corpus in the Superior Court and re-filed in the Court of Appeal. As a result, the Writ was granted and sent back to the Superior Court for an Evidentiary Hearing. The District Attorney then stipulated that the conviction could be vacated. A joint stipulation, regarding a conviction on a lesser offense with credit for time served, without probation or parole, was then entered. Ultimately, our client was released from prison.
