OUTCOME: Judgments for $16.5 million in actual damages entered against multiple defendants

I represented the plaintiff, who sought recovery of approximately $16.5 million from the defendants. Plaintiff alleged a series of causes of action, including breaches of fiduciary duty and knowing par ... ticipation in a breach of fiduciary duty. The court entered judgment against the corporate entity defendants for $16.5 million in actual damages after a bench trial. The 5th Circuit upheld the award, and also reinstated claims against the two individual defendants.

Some of the legal issues involved application of anti-concurrent causation clauses in commercial policies, interpretation and application of various provisions of contracts, including attachment of an excess carrier's liability and an excess policy's adoption of underlying policy terms.
