A 26 year-old male, father of two, was killed in a car accident on Route 31 in Batavia, Illinois, when the driver of a pickup truck crossed the center line and caused a head on collision with the deced ... ent. The only independent witness to the collision thought that the decedent was at fault for the collision but we were able to prove that the driver of the pickup truck was at fault. We were also able to prove that he was within the scope of his employment at time of accident. The decedent's provable earning losses were diminished because he was not a U.S. citizen and did not have much in the way of provable earnings.
