Nursing home filed for Guardianship against my client.
OUTCOME: Trustee and POA were replaced, nursing home was paid and client is moving back into the community with Medicaid.
Nursing home wanted to have a guardian appointed for a resident because the Trustee and Power of Attorney were not responding to requests for information for Medicaid.
OUTCOME: Preserved $100,000 and client recieved Nursing Home benefits

OUTCOME: My client won the case, nephew not appointed. Ultimately we had guardianship revoked, he has full time live in care 24 hours a day and he is living near the ocean and very happy almost three years later!
85 year old Client was admitted to a nursing home by his only relative, his nephew. Client had in excess of two million dollars. Nephew had all of his uncle's bank books and was named as Power of Att ... orney. Client was not appropriate for a nursing home, he had full capacity. Nephew refused to apprise client of the status of his finances. Client called me and asked to please get him out of the nursing home. When the nephew found out his uncle consulted with an attorney he filed one day earlier than me for Guardianship, my client filed as a self petitioner for the purposes of obtaining a guardian to help him get a hold on his finances. We filed our petition and asked that it be joined with the initial petition. We advised the client to revoke the power of attorney which he did. We appeared at hearings over three separate dates to argue that the client did not want nephew appointed. All client wanted was to live on his own, near the ocean.
