Client was charged with possession of marijuana. I advised him to obtain his Michigan Medical Marijuana card when he told me that he needed to use marijuana due to anxiety etc. He plead guilty to the c ... harge and obtained a 7411 deferment of conviction to keep it off his record. When I advised the Judge he possessed a medical marijuana card the Judge stated clearly that he would not allow the client to smoke marijuana while on probation. After oral argument by the Brian Dailey of the Dailey Law Firm, PC the judge did a 180 degree turn around and ordered that the client may indeed take is prescription of medical marijuana while on probation.
