Biography
James D. Murtha has been a member of the consumer credit industry for over thirty years, having held key positions in several of the nation’s leading debt-collection firms. As an expert in FDCPA, FCRA and HIPAA issues, Mr. Murtha has written and taught on the subjects and has successfully litigated cases in defense of consumers’ rights. In addition to his passion for consumer defense, Mr. Murtha is an outspoken advocate of Constitutional issues and has championed the right to keep and bear arms in court.
Practicing in the courts of the State of New York, as well as in federal courts, Mr. Murtha focuses his practice on landlord-tenant law, where he applies his skill and expertise to litigating summary proceedings to recover possession of real property. A large part of his practice is still dedicated to his passion for consumer defense litigation, in which he protects the rights of consumers from the unfair practices of debt-collection agencies, creditors, automobile dealerships, banks, student loan companies and other businesses. He also specializes in bringing special proceedings in New York State Supreme Court and Second Amendment litigation in defense of the rights of law-abiding citizens to keep and bear arms, and against civil and criminal charges stemming from lawful firearms ownership and use, as well as litigation in defense of licensed firearms dealers in civil liability matters.
In addition to his duties as a Managing Member of the MURTHA LAW FIRM, LLC, Mr. Murtha has also devoted his time to teaching consumer debt classes and providing consumer education as a public service in association with the public library system of Suffolk County. James D. Murtha is admitted to practice in all the courts of the State of New York and in the United States District Court for both the Eastern and Southern Districts of New York.

My brother and I hired this man for my mother who has dementia. He would only talk with her even though we paid him. We told him she wasn't a reliable source of information but he would not listen. Replied last October 20, 2016I pride myself on my professionalism, and I take my obligations to my clients very seriously. That is why this review is so troubling to me. That, and because I have never had a client relationship of the type described in the review. To be certain, I checked the files of every client I have represented. I found that no one has ever retained me to represent their mother. This is not surprising, since attorneys generally are not retained in that manner. Nor have I ever represented a client whom I knew to suffer from dementia. Either the person who posted this anonymous review has mistaken me for another attorney, or the review is intentionally false. In either case, there is nothing more I can add, since the review is not legitimate. But I remain grateful to my loyal client base, whose kind and generous reviews remind me of why I chose the law as my profession: to help people resolve issues they cannot resolve themselves. For me, that is the reward of practicing law. Thanks again to all those who allow me the privilege of helping them.
