OUTCOME: 10 year prison sentence reduced to 3 year prison sentence
Charge: Armed Violence & Possession of a Controlled Substance with Intent to Deliver Search was executed on an apartment. Client, who had multiple felony convictions, was not the target of the s ... earch warrant. Target of the search warrant not home. A loaded firearm and controlled substances in plain view were found in the bedroom where client was found sleeping. Proof of residency was found in client's name in the same bedroom. Client made statements to the police about the firearm. Client was found guilty and was facing a 10 year minimum prison sentence. This was an 85% sentence, not day for day credit. Client was looking at 8-1/2 years behind bars. I filed a motion for new trial based on insufficiency of evidence. Judge granted the motion for new trial as to the armed violence charge. Client received received 3 years in prison with day for day good time credit. Client will serve 1-1/2 years, eligible for work release in 8 months.

Charge: Aggravated DUI grave bodily injury Captured on video. Client was driving to work and stopped car. Client had a diabetic episode. Client lost consciousness. Car began moving forward at ... a high rate of speed. Car slammed head on into a car carrying a small child. Both parties had severe injuries. Eight months later, police charge client with Aggravated DUI based on narcotics bein found in client's blood. Bond was $750,000. I obtained a report from the Paramedics that stated they gave client the narcotic during there course of treatment. Aggravated DUI charges dropped. Bond was reduced drastically. Client was able to post bond. New charges filed by State of Aggravated Reckless Driving based on client should have known that he was going to have a diabetic episode. I obtained client's blood checking machine. I had client's diabetes doctor reviewed blood checking machine. Doctor found that client tested in the proper range 25 minutes before car crash. Not a foreseeable situation. I arranged a phone conference with the State and client's Diabetes doctor. Two days later all felony charges dropped.

Charge: First Degree Murder A gangland drive-by shooting was witnessed by a police officer from about 2 blocks away. The officer saw the gun fire and brake lights of the offending car. The car ... was stopped within about 2 minutes. Client was not found in the car. Gun and bullets found in the car. After being arrested a few months later, the Police Detective and the State prepared reports that client made admissions and was taken to the scene and re-inacted the shooting for them. At trial, I brought out evidence about where the alleged guns came from. Testimony came out that an identified gang member who lived about 1 mile from the courthouse supplied the guns. This person, who was still living, was never questioned or brought into court to testify. Also, I brought out that my client's alleged statements were bogus because they were never written or recorded.
