People v. Daniel Flynn - Not Guilty After Trial

OUTCOME: Acquittal

Possession of a Weapon. The client was falsely accused after being set up by two former police Detectives at the behest of a Divorce lawyer and after an extremely hard fought jury trial before a Judge ... who wanted to put this Defendant in jail, he was found not guilty. To make matters worse, the Defendant left in the middle of jury deliberations and his bail was revoked and a Warrant was issued for his immediate arrest. He was still acquitted after a full day of jury deliberations.

People v. Mayweather - Not Guilty After Trial

OUTCOME: Not Guilty after extensive trial

Mayweather was charged with Sale of a Controlled Substance, to wit: Crack Cocaine. He was arrested inside of a so-called Crack House with a number of other people who were also charged with possession ... . He had already been convicted of Drug Sales before and he was offered 3-6 years in jail. He refused all offers and insisted upon a trial. After an extensive trial, he was acquitted of all charges. It seems he was a working man and knew about the Crack House and thought after a long week of work, he'd just stop in and get some sex for a few bucks to satisfy a crack whore who was staying there. Unfortunately for him, the police raided the house at that very time and he was caught up in the raid and becaue of his history as a crack dealer in the past, they immediately arrested him and prosecuted him.

Client was charged with DWI and speeding and after trial was acquitted of all charges. One juror told him after the case "We acquitted you, but don't do it again."

People v. John Restivo - INNOCENT - Cleared by DNA after 20 Years

OUTCOME: Convicted after trial, but DNA cleared him

John Restivo was charged with Rape 1st and Murder 2nd along with two other men. They were innocent, but the police hid evidence and the DA convicted them with trumped up evidence and by coercing an Al ... ibi witness to lie. After conviction, I remained on the case for 17 years appealing the case and getting DNA tests done for him. They eventually cleared him and his conviction was set aside and he was released. I never gave up on the case and never quit on the client. I pursued the case when nobody else would take it on. I brought Habeas Corpus Motions and Federal Writs seeking to get a DNA test done and defended the client through every onslaught of the District Attorney until three DNA tests confirmed his innocence. Even then, the DA refused to abandon his persecution of the men. One of them was eventually forced to go through another trial and win before the DA finally gave up and set them free. The entire case took almost twenty years, yet I never stopped working for my client.

OUTCOME: Robbery conviction of Police Officer

Police Officer from Nassau County, NY, charged with robbing his own bank in Suffolk County. The case was tried three (3) times. The first time was by the famous criminal defense attorney John Sutter ... and was overturned on Appeal. The second was tried by Theodore W. Robinson to a hung jury that took five days to deliberate (the longest in the history of Suffolk County at that time) before ending the case in a mistrial. The third trial was by Theodore Robinson and it ended in a conviction after four days of deliberations. Despite the fact that he was innocent (in my opinion) of the charges, he served time and was never heard from again. This was a miscarriage of justice in my opinion, but is included to give a full explanation of my trials for balance purposes. Even some innocent people can be convicted. Even a cop. This was one of the hardest cases to reconcile in my mind as a defense attorney and was a heart breaker. It ended his marriage and his freedom for a period of time.

OUTCOME: Convicted as charged

This Defendant was charged with Armed Robbery for robbing two college kids who were also drug dealers that had just sold the would-be robbers drugs. After taking the barbituits, they drank alcohol and ... the combination caused them to get aggressive. They returned to the car in which the students were parked and stuck a shotgun in the window and demanded the drugs and their money. There was a skuffle and a fight over the shotgun. This Defendant pulled it away and shot it into the air in the middle of a crowded park. After a trial, he and his co-defendant (known as Robin Hood because he carried a cross-bow during the robbery and fell asleep in the middle of the whole thing - until the shotgun went off). They were caught nearby after hitting a tree and trying to hide their stolen drugs in the crotch of a tree in front of numerous witnesses as the police arrived. It was a jury trial for armed robbery.

Assault 3rd ("A" Misdemeanor) charge for getting into a fist fight at a carnival. This was my first trial and it was neither one nor lost. It ended in a mistrial and was retried the very next day to ... an acquittal. It was a rough case because the Defendant was a rough and tumble kind of guy who really looked and sounded guilty, but the DA didn't have the necessary medical proof to prove the injury needed for a conviction.

Glade was charged with Rape 1st and had another Rape 1st pending behind this case. It was an extensive trial with numerous witnesses and testimony and he was eventually found not guility. The second ... rape case was eventually dismissed due to technical reasons and he was completely exonerated of both Rape cases. It was a big win considering he had two rape cases pending at the same time against him.
