Unemployment takes approximately 4-6 weeks before the first check, longer if the employer asks for a hearing to fight it. If the letter backs up...

I believe the NYS Dept of Labor has a task force for contractors. If they are not paying minimum wage, the contractors may be prosecuted criminally.

I can't comment on Canadian laws, but in US, this question is determined by each state. I agree with attorney White's answer as far as NY law.
