Bernas v Gerdes
Jan 01, 2007OUTCOME: settlement for Plaintiff
Also known in the press as the "Cupid Case". Plaintiff ex wife sued ex husband's paramour for alienation of affection and recovered an undisclosed monetary award. What was unique about the case was tha ... t all parties resided in the state of Florida, which does not recognize the alienation tort claim. The state of Illinois does have such a statute, although rarely used. The Plaintiff, whom we represented, successfully used a minimum contacts argument, also known as the "long arm" statute to gain jurisdiction. The case was filed in Cook County, Illinois.
