Buchanan v. Legan
Dec 07, 2017OUTCOME: Affirmance of the trial court, in our client's favor
Susan recently successfully defended her client on appeal to the Illinois Third District Appellate Court. Having won the case at the trial level, Susan prevailed again on appeal in a unanimous decisio ... n. The case involved an attempt by a child's mother to simultaneously disestablish the existing parent-child relationship between the child and the mother's ex-husband and to establish a new father. That petition was dismissed upon a motion by the child's representative. Several years passed, and the then 19 year old child returned to court, filing her own petition to declare the same man who had been named defendant in her mother's earlier case as her legal father. Susan successfully argued that the doctrine of res judicata barred the subsequent action to establish parentage.
