OUTCOME: Not guilty

Minor plaintiff had a non-descended testicle at birth. It subsequently descended. The minor was under the care of the defendant from age five months to nine years. After that he was diagnosed with a ... non-descended testicle that was surgically removed. Defense maintained the testicle was descended, as shown by growth of the testicle and scrotum development and that the testicle ascended, which is a known condition. Not guilty as to the defendant.

OUTCOME: Not guilty as to both defendants

Plaintiff alleged delayed diagnosis of breast cancer. Defendant physician was asked for a "curb side consult" as to the findings of milk of calcium on mammogram, on date of scheduled needle biopsy of ... April 5, 1995. Plaintiff eventually did not have biopsy. She had one follow-up mammogram July 10, 1995, that showed regression of calcifications, and though told to return in March 1996, she did not return for followup until September 1996. At that time she had a 1 cm. spiculated mass and 18 positive nodes. Defense was that either follow-up with mammogram or biopsy was reasonable care.

Plaintiff claimed to have slipped and fallen on torn carpeting coming down stairs. The fall was unwitnesses. At end of plaintiff's case, directed verdict for defendant.

OUTCOME: Not guilty for defendant

Minor plaintiff died of malnutrition at age 7 weeks. Seen by family practice physician Dr. Savalia's office for initial visit and on day of death. The physician tried to have an ambulance called to t ... ransport the child due to weight loss. Mother refused and eventually took the child to the hospital, where he was pronounced dead of malnutrition. Mother and father were named as third party defendants. Case was upheld on appeal. Parents were both found to be sole proximate cause of death.

Plaintiff alleged failure to timely diagnose Churg-Strauss syndrome. Dr. Dold was the allergist treating the plaintiff. Directed verdict at the end of plaintiff's case in chief
