Minor plaintiff had a non-descended testicle at birth. It subsequently descended. The minor was under the care of the defendant from age five months to nine years. After that he was diagnosed with a ... non-descended testicle that was surgically removed. Defense maintained the testicle was descended, as shown by growth of the testicle and scrotum development and that the testicle ascended, which is a known condition. Not guilty as to the defendant.
