OUTCOME: Result in favour of our client Plaintiff.

Owner of Property suffered extensive fire damage as result of Tenant negligent smoking. Property-Landlord sued Tenant for Negligence. Defense argued there was no liablility and in support of such cit ... ed long history of case law setting forth that a Landlord may not sue his tenant as the payment of rent to the landlord is used to purchase insurance on the building and therefore the tenant is a "Co-Insured". A Co-Insured may not sue another insured. Our office successfully argued exceptions to this long standing precedent and was successful.
