Chrystie Nguyen sued her employer, the University of Texas, after she was discharged from her job with the law school's Continuing Legal Education department. She claimed race/national origin and gend ... er discrimination, while the University claimed that she was discharged for poor performance. Despite some challenging facts, the case was ultimately dismissed on summary judgment and affirmed on appeal to the Fifth Circuit Court of Appeals. Mr. Perkins was lead counsel for the University.

OUTCOME: Summary Judgment granted and affirmed on appeal

The plaintiff was discharged for violation of employer rules; however, she had recently asserted rights under the Family Medical Leave Act. After her discharge, she sued for disability discrimination ... and FMLA interference/retaliation. Her claims were dismissed on summary judgment by the federal district court. That judgment was upheld on appeal to the Fifth Circuit. Mr. Perkins was lead counsel for the Defendants.

OUTCOME: The case was resolved without judgment and the matter dismissed.

Texas state officials were sued personally under the federal civil rights statutes after an investigation revealed an organized "fight club" at the Corpus Christi State School in which line level emplo ... yees were forcing residents of the mental health facility to fight each other for the entertainment of the staff. Mr. Perkins was lead counsel for the defendants, none of whom were personally involved in the alleged fight club, but rather had executive oversight responsibilities over all Texas state school facilities.

OUTCOME: All claims were dismissed either at the trial level or on appeal on the ground of state sovereign immunity.
