On October 22, 2013 Plaintiff Stefanie Walther was riding her bicycle in downtown Chicago on her way to work at Rush university Hospital where she was employed as a research scientist while she was in ... the US on a work visa. Walther was traveling behind a Flash Cab with Defendant Jamie Weil seated in the rear seat. As Plaintiff Walther passed the right rear of the Flash Cab, without any warning Defendant Weil opened her rear passenger door and struck Plaintiff Walther on her bicycle. The force of the impact threw Walther from her bicycle onto her chest and shoulder to the pavement below. Plaintiff initially suffered from labial lacerations, hip injury and a left shoulder impaction fracture. Shortly thereafter Plaintiff began to suffer from dizzy spells and erratic heart rhythms that her doctors diagnosed her with Postrual Orthostatic Tachycardia Syndrome, commonly referred to as POTS. It was undisputed in this case that Walther now suffers from POTS and is disabled for life due to her POTS condition. Due to her POTS condition, Plaintiff Walther was unable to perform her research duties which resulted in the expiration of her work visa (J1), the loss of her employment and ultimately her being forced to return to her home country (Germany)
