The Illinois Supreme Court reversed a conviction and ordered a new trial after Don Ramsell took over the appeal of a woman convicted of DUI. Ramsell proved that the sobriety test given to the woman was ... not proven to have been conducted in accordance with NHTSA standards. This case was followed by police and attorneys nationwide. The decision establishes new standards for the HGN (eye) test in Illinois, limiting its value dramtically. The test can no longer be used to prove actual intoxication or alcohol concentration, and the police will no be required to undertake extensive training before using it on the street.
