FACTS: Plaintiff Awand, while going to work on SR 24 in Oakland, California, had emergency car problems and was forced to stop in the slow lane. Many cars had time to pass her and did. Sadly, because o ... f inattentive driving, the Macalino vehicle impacted her with such force that the impact killed Awand. Awand was married and the mother of two adult children. Case settled for policy limits of $1.25 million, within 15 months of accident. 2. Hixon V Shipman, Desert Hot Springs, Riverside County, Dangerous Premises/Fall from a staircase. Plaintiff Hixon rented a home in Desert Hot Springs. The home included a dangerous condition of a slippery, tiled staircase from the second floor bedroom to the main floor with no railing. One morning Hixon was coming down for breakfast when he slipped on the tiled steps and fell 10 feet off the staircase. Hixon sustained fractures, head fractures, hand, elbow, shoulder, and chest injuries. Hixon required surgical repair to his right elbow and to his left wrist, and left hand. We litigated the case for nine months, and settled it at a mediation for $340,000.00.
