They have full discretion to deny or admit you...even if one has advance parole. Advance parole is no guarantee.

Not sure when to file for removing condition on green card. Is being married for 3 years have anything to do with that?

You file the I-751 jointly 90 days within the expiration of your conditional green card assuming that you are still married to your husband.

Nope.. it appears that you can't avoid it. The fee waiver under form I-912 appears not to apply to you....
