Our client was charged with four counts of unlawful use of a credit card, theft, domestic battery and possession of a stolen motor vehicle. Additionally, DCFS guardianship was recommended, which would ... take the juvenile from her father's custody. Harter & Schottland succeeded in having the credit card charges and domestic battery dismissed. Additionally, the juvenile avoided convictions on the remaining charges. The request for DCFS guardianship was defeated and the juvenile was allowed to live with her mother.

Our client's house was searched the police discovered a quarter of a pound of cannabis. Harter & Schottland filed a motion to suppress alleging that the police entered our client's house illegally. T ... he police did not have a search warrant, but claimed our client's mother who lived at the house consented to the search. Our client's mother did not speak english. The police did not speak her language. The consent to search was in English. After a hearing on the motion to suppress, the court granted our motion to suppress. Not being able to introduce evidence of what was found in the home, the prosecutor was unable to prove the case.
