Innocent Bystander v. Police Officer
N/AOUTCOME: $82,000 for victim of police shooting
This is a case which I am particularly proud of because I had to overcome Tort Immunity laws which protected the defendants, City of Chicago Police Officers. An officer who shot 4 rounds at a couple o ... f German Shepard dogs, missed them. His bullet instead ricocheted and hit my client on the knee cap. My client's injuries were caused by the shrapnel which penetrated his knee cap. Surgeons at Illinois Masonic took out the shrapnel and he had to wear a cast for a few months, but he made full recovery. The City of Chicago didn't offer much to settle the case before trial, so I had to take the case to the jury. The City argued that since the officer feared for his life, his use of deadly force to defend himself was reasonable. The jury did not buy that argument. I argued that while the officer may have been fearful, something that was reasonable but we could not prove, he should not have used deadly force. He had, at his disposal, other methods of protecting himself, such using pepper spray, in order to subdue the dogs. The jury sided with us and gave my client a fair amount of money. Given the difficulty of this case, I can honestly say when the jury held for my client, I was extremely proud and very happy for my client. The trial lasted about a week with multiple witnesses. The City had its share of police officers coming to court to testify on behalf of one of their own. Nevertheless, we won.
