Our client was charged with her 2nd DUI in less than 5 years. She was pulled over in Brookfield after a citizen complaint was called in of an intoxicated driver falling asleep at the wheel. The Offic ... er pulled our client over and administered all the standardized field tests. On direct examination, the Officer testified that our client failed each and every test and video evidence was presented. Mr. LaScola cross examined the Officer thoroughly on all of his testimony regarding how she failed these tests, pointing out both inconsistencies and also highlighting the strong points of her performance on these tests showing that technical failure points doesn’t overshadow overall performance. The 4th District Judge agreed and found our client NOT GUILTY of the DUI.

Client charged with striking a bicyclist at a protest in Naperville. The bicyclist alleged my client didn’t exercise caution exiting a private drive while leaving a gas station near the protest. The ... bicyclist actually tried to stop my client from exiting the lot and extended her leg, making contact with my client’s vehicle before falling off her bicycle. In cross-examination she admitted this and my client clearly testified to this as well. Ultimately, my client was found not guilty and acquitted of the charges.

Mr. LaScola detected a technical issue with the client's documentation and capitalized on this during a license suspension hearing in Will County. The Judge who was very intelligent and analytical understood the issue perfectly and Mr. LaScola argued that the error committed by the Illinois State Trooper violated his client's procedural and substantive due process rights. As a result, the hearing was a success and Mr. LaScola was able to secure the Rescission of the Statutory Summary Suspension. Now, the client is no longer suspended in Illinois for the DUI and will be able to work and provide for his family during the pendency of the case.

Our client was pulled over for turning down the wrong street at a well-known traffic roundabout at a little after 4am. The Officer curves the vehicle in the wrong lane of traffic & initiated the inves ... tigation. Due to language issues, the Officer called in a backup unit to assist. At trial, Mr. LaScola challenges the accuracy of the language translation and pointed out other factors that assisted the Court in his analysis of the field sobriety tests administered - focusing on all the positive aspects of the client’s performance and noting how well she did given the lack of instruction in her native language. After the evidence, the court agreed and found our client Not Guilty!!!

OUTCOME: Supervision Reinstated - Driving Privileges Restored!!!

Our client found himself in violation of his Court Supervision after first being issued a warrant for failure to report to court monitoring, and later having the Supervision revoked and a conviction be ... ing entered in its place. As a result, our client's driving privileges were revoked by the Secretary of State once the conviction was reported to them by the Clerk of the Circuit Court. Mr. LaScola got involved and encouraged the client to complete all the conditions of his sentence and pay all outstanding fines. After this was performed by the client, a motion to vacate the conviction was filed by Mr. LaScola. In court , he argued to have the Supervision reinstated after showing that all conditions of the sentence were satisfied. The Court agreed to reinstate Supervision and a Court Order was then sent to the Secretary of State. Mr. LaScola sent a certified copy of this Order to his courier in Springfield for hand delivery to the Secretary of State. The client's driving privileges were reinstated the next day!!!
