Retained by client A. K. to seek contribution from former spouse to college expenses incurred by A. K. 5 years prior to filing Motion for Contribution. Motion was immediately challenged by A. K.'s att ... orney through a Motion to Dismiss. A. K.'s attorney argued that the Motion for Contribution should be dismissed because the college expenditures were incurred PRIOR to the filing of the Petition for Contribution, and accordingly, the Motion improperly sought to modify the status quo retroactively. Martin Osinski successfully defeated the Motion to Dismiss by arguing that the specific language of the parties Judgment for Dissolution created an affirmative obligation on the parties to contribute to the child's college expenses. The oral argument and case law in support of Martin's responsive brief successfully persuaded the Court that A. K. was able to seek retroactive contribution since the Motion for Contribution did not change the obligations of the parties under the terms of the Judgment.
