Muhammad v. Islamic Society of Orange County
N/A
OUTCOME: $4.0 million judgment
Mr. Fletcher and his partner, Edmond Connor, represented Dr. Zakiyyah Muhammad, an African-American woman, in a three and a half month jury trial and through appeal in a wrongful discrimination matter.... Dr. Muhammad is a nationally recognized scholar in Islamic Education, and was hired by the Islamic Society of Orange County to improve the quality of the Orange Crescent School. Dr. Muhammad vastly improved the quality of the school, and even got it accredited through WASC. She was recognized by the Islamic Society of Orange County as its Educator of the Year, and was heraleded by most members of the community.
In 2003, a new president of the school was appointed and he immediately began to mistreat Dr. Muhammad. His mistreament continued to escalate and after Dr. Muhammad complained to the Islamic Society that she was being mistreated because of her gender and asked for an apology, she was terminated without cause.
Dr. Muhammad was referred to Connor, Fletcher & Williams LLP,. Upon hearing Dr. Muhammad's story, Ed Connor agreed to take on her case even though the firm's pracitice primarily consists of representing large corporations in complex litigation matters. Mr. Connor believed that once the discrimination was exposed, the Islamic Society's board members would demand her immediate reinstatement.
Instead, they decided to "protect the society, regardless of who was wrong." That is a quote from one of the many smoking gun documents obtained by Connor, Fletcher & Williams in discovery.
When the case did not settle Mr. Fletcher and Mr. Connor took it to trial, and a jury agreed that Dr. Muhammad had suffered extensive damages and that the Islamic Society of Orange County was guilty of discriminating against her on the basis of her gender and national origin. They awarded her approximately $1 million and the Court ordered the Islamic Society of Ornage County to pay her attorney's fees, which had exceed $3 million over the course of hte five years of litigation.

The insurance company's lawyers employed the "standard playbook" of not attempting to settle the case even though it was clear the damages w...ould exceed Mr. Fletcher's clients policy limits. Mr. Fletcher advised the client on how to position the case to either force the insurance company to settle within policy limits or position himself to be able to recover damages from the insurance carrier for bad faith refusal to settle. Fortunately, the insurance company chose to settle the case and the client obtained a confidential settlement funded entirely by the insurance company.
