First degree arson case against a person who in a rural community in Fannin County burned his house down because his girlfriend had left him. Because the State has to prove that a person charged with a ... rson of a habitation "knew it was within an incorporated city or town" in order to get a conviction evidence was presented that no one knew the exact boundaries of the city of 289 residents because there was no survey plat. There was additional evidence presented that the 1933 incorporation of the community was likely faulty. Jury focused on both of these issues in finding JM not guilty.
