Daniel Marc Braude

As chair of Wilson Elser's E-Discovery Practice Team, my practice focuses on complex litigation involving product liability and commercial disputes, with an emphasis on related electronic discovery and document preservation issues. In addition, I am a Certified Information Privacy Professional (CIPP/US) and I serve as an Adjunct Professor at Pace Law School where I teach a course on e-Discovery.

PRODUCT LIABILITY
In the product liability field, I represent manufacturers including those in the transportation and recreational products industries. My experience includes case management and coordination of defense efforts in pattern litigation and appearing as coordinating counsel at depositions around the country. I frequently confer and consult with engineers on technical issues related to product design and manufacturing.

COMMERCIAL LITIGATION & COUNSELING
I represent clients in commercial disputes, as either plaintiffs or defendants, often in matters involving subcontractors and component suppliers. In addition, I counsel contractors in the public procurement arena with regard to responding to requests for proposals and related issues.

E-DISCOVERY
As chair of my firm's e-Discovery practice, I serve as a resource within the firm and for clients on a wide range of topics relating to electronically stored information (ESI). I serve as discovery counsel in commercial and product liability matters, frequently on behalf of manufacturers engaged in pattern litigation.

INFORMATION GOVERNANCE
I work with clients to effectively manage and organize their information assets while containing costs and minimizing related organizational risks. I audit, assess and investigate current information governance practices and guide clients toward their objectives by drafting document-retention plans, social media guidelines, cloud computing policies, permissible use policies and “bring your own device” policies.
