Joseph Miller

I am one of the founding Partners of Miller & Lee LLP.

I litigate cases before New York State courts and Federal courts. I defend premises liability cases, self storage facility claims, product liability actions, construction site accidents, toxic tort claims, and Americans with Disabilities Act discrimination claims. I appear at trial, arbitration, and mediation for all clients. I also appear before administrative agencies and New York State courts on building code violations, fire department code violations, and consumer affairs violations.

I am an accomplished appellate attorney with experience in all phases of appellate practice. I have written more than 100 appellate briefs and argued approximately 70 appeals, including appeals to the New York State Court of Appeals. I routinely prepare opinion letters on the viability of an appeal and prepare and argue motions before the appellate courts.

I represent several self-storage companies. I am a leading authority on self storage law in the State of New York. In addition to defending claims brought against self-storage companies for wrongful sale under Lien Law 182, breach of contract, conversion, personal injuries, debt collection practices, and property damage, I prosecute eviction proceedings, advise on such issues as the effect of bankruptcy and death of a tenant on leases and a lien claim, and draft occupancy agreements, auction terms, and agreements ancillary to the rental of self-storage units.

I defend self-insured companies and companies with large self-insured retentions in workers' compensation claims. I appear at hearings and trials, depose physicians on medical issues, prepare administrative appeals, and advise clients on workers' compensation issues
