My client was charged with manufacturing and delivery of Cannabis- A felony. The police officers searched his home without a search warrant, claiming they had consent from the owner (defendant). I fi ... led a motion to suppress the seach based upon a violation of the Fourth Amendment which protects citizens against unreasonalbe searches and seizures. The judge granted my motion and suppressed all the drugs found in the home. The judge agreed that the police needed a warrant to enter the home. He also agreed that the alleged consent given to the police was not voluntary. Further, the police did not sufficiently corroborate (check out or investigate) an anonymous tip which led them to the Defenant's home in the first place. Because the drugs were suppressed , the prosecutor was forced to dismiss all charges.
