If you file a cross motion for summary judgment, then your cross motion may be decided even if the party who filed the original motion withdraws...

A form may be legal if it is executed and prepared properly. A mistake can invalidate it. t is best to have an attorney prepare it.

Would my cosigner on an auto loan still be liable on the loan if he does not enter into a reaffirmation agreement.

Cosigner is a guarantor of the loan. If you do not pay, then they are liable. Your bankruptcy does not effect them.
