An ill Queens boy with a history of severe asthma attacks was sent home on a city bus by his school's nurse, only to die at a hospital less than an hour later, his family claims-in a law suit.
Joseph ...Carter, 13 went to the nurse at St. Anthony of Padua School around 12:30 p.m. on April 24 with an asthma attack, according to a lawsuit filed last month in Queens Supreme Court against the city and the nurse.
The RN, Judith Wackman, allegedly kept Carter in her office at the South Ozone Park School for two hours, where he used an inhaler before sending him home on a city bus not with an adult, but with his sister, according to court papers.
"His sister said that while he was on the bus, he was crying because he was in such distress" his lawyer Eliot Wolf said.
She told her mom how much pain he was in.
By the time the suffering child got to his Richmond Hill house at around 2:40 p.m. he was so sick that his mother called 911, according to court documents.
"If 911 was called 10 minutes earlier, it would have made a difference. This kid would have lived" Wolf said.
Medics got Carter, who had been intubated at least once before because of his asthma attacks, to Jamaica Hospital where he was pronounced dead.
Wackman should have realized how serious the attack was and gotten Carter to a hospital, mom Janice Burch alleges in court papers.
"The mother had no reason to believe that there was a reason to worry when she sent him off to school" Wolf said.
"To allow a child like that on public transportation without making arrangements to safeguard the child is unacceptable."
The city which provides nursing staff to public and religious schools, did not comment on the law suit.
