Since this happened years ago you are probably out of time. Colorado statute of limitations on libel/slander is 1 yr. §13-80-103(1)(a)

He is responsible for his negligence and if the amount in question is within small claims court limits then that is where you should sue him.

Sue the tattoo shop and their insurance company will defend and indemnify them. If the scar is bad consider hiring counsel.
