No, but if the Lender ultimately forecloses on the two of you, then neither of your "consent" will prove to be necessary.

If you remove yourself from the deed you WILL remain on the mortgage, whether you like it or not.
Does it take both owners (husband & wife) listed on deed to sign a listing agreement in the state of NY?

An agreement isn't binding on a non-signatory. She doesn't have to do a thing.

Statutorily, likely you . Contractually, read the contract. Also why would your utility bills be an impediment to you selling?

If your mother's final wish was verbalized that it carries no weight. You can initiate a lawsuit and force the sale of the property however.
