The Court and DA may know about the prior, but you will likely get it dismissed again or ACD'd.

Unless your employer is the Government, a fingerprint search should not disclose your history. However, there are other means of doing background...

NYS does not expunge. If you do not have a criminal record, there is nothing to erase.
