Client is a 21 year old man that was accused of driving under the influence. There was no eye-witness to the driving but the police officer asserted that client told him that he was driving. Client a ... nd his witnesses said that he had not driven and was merely sleeping it off after going to a club. At a suppression motion I was able to demonstrate that the Officer was not in a position to hear client admit driving and that there was too much radio interference to hear properly. On the day of trial the D.A. dismissed the charges.
