Axletree Solutions, Inc. v. IntellectEU, NV, et al., U.S. District Court, District of New Jersey (2024). Represented IntellectEU in defense against a motion for preliminary injunction brought by a form ... er business partner, Axletree Solutions. Axletree alleged that IntellectEU's new software product, CAT-IM, breached non-compete and non-solicitation covenants from a 2017 agreement between the parties, and sought to enjoin its marketing and sale. IntellectEU's position was that a subsequent 2019 Services Agreement, which contained an integration clause and omitted the earlier covenants, superseded the 2017 restrictions. Conducted the evidentiary hearing, including examination of witnesses on both sides, and argued the opposition to the motion.
