Plaintiff was struck by a motor vehicle. The vehicle's driver never stopped and was never identified. Plaintiff sustained an injury to his head. Plaintiff sued Motor Vehicle Accident Indemnification Co ... rp., which provides compensation to accident victims caused by underinsured or uninsured motorists. Plaintiff alleged that the vehicle's driver was negligent in the operation of his or her vehicle. Plaintiff claimed that he suffers a residual reduction of his right eye's vision and severe residual headaches. Plaintiff sought recovery of damages for his past and future pain and suffering. Defense counsel contended that the plaintiff was not wearing his eyeglasses and that, as such, he did not see the turning vehicle approach and simply walked into the vehicle's path.
