You most probably cannot as the regulations state that you can stay for a combined 6 years in L and/or H status unless you have filed a green ...

As long as there is a "commonality" of ownership between the 2 entities then you can qualify.
Commonality means 51% of joint ownership.

The filing of the I-130 by you will not help her with her hospital situation. They may also want you to be a guarantor on the hospital bills.

You can try to enter the country by bringing your court records and showing it to the customs officer and see if they will accept it.
