An Army Staff Sergeant at Fort Lee is accused of molesting a ten-year old girl. Knowing that sexual assault of a child cases are the hardest to defend because in practical terms there is no presumptio ... n of innocence, Mr. Nathan Freeburg conducts an in-depth investigation into the allegation. Meanwhile, the prosecution does everything possible to oppose the trial being delayed so that Mr. Freeburg can be on the case and the Army brings in an expert field-grade prosecutor from the Trial Counsel Assistance Program (TCAP) to oppose him. After investigating the case and consulting with medical experts, Mr. Freeburg realizes that the allegation likely was the result of a dream based upon a movie the child had watched. After preparing for every eventuality, Mr. Freeburg uses cross-examination and expert witnesses to destroy the government’s case in front of a military jury.

Coast Guard Sailor with 17 years of combined federal service is accused of raping his wife, assaulting his children, adultery and sexually assaulting another Sailor. Upon retention, Mr. Nathan Freeburg ... investigated and exposed the wife’s lies as well as her motive to fabricate, which was to gain full custody of their children. With the destruction of the prosecution’s case, the Coast Guard elected instead to pursue a separation board instead of a court-martial! Although the biased separation board voted to separate the Sailor, Mr. Freeburg prepared and submitted a memorandum of deficiency showing the legal problems with the board and concerns about the CGIS investigation that was conducted on his client. As a response, the Coast Guard drops the separation action.

Army Sergeant at Joint Base Elmendorf-Richardson is accused of directing a group sexual assault of an 18-year-old Air Force service member and also of sexually assaulting this alleged victim himself on ... multiple occasions throughout the evening, for a total of eight specifications of sexual assault under the UCMJ. Mr. Nathan Freeburg was retained months before the preferral of charges and conducted an in-depth investigation into the allegations. After charges are preferred and referred, one of the two co-accused junior soldiers made a plea deal and pled guilty to sexual assault resulting in sex offender registration for that soldier and two years in prison. In return he agreed to testify against Mr. Freeburg’s client. Despite all of these strikes against the client, Mr. Freeburg uses a robust cross-examination defense to destroy the government’s case.

Marine Sergeant (E-5) and recruiter at Great Lakes Naval Station is originally referred to a Special Court-Martial for alleged conspiracy to conduct a fraudulent enlistment and alleged false official s ... tatements. Mr. Nathan Freeburg files multiple dispositive motions with the result that the Marine Corps dismisses the court-martial charges against the client. Then the Marine Corps subsequently sends client directly to a separation board. At the separation board, Mr. Freeburg calls a number of character witnesses and engages in a full-scale assault on the Government’s evidence. The Government argues for an Other than Honorable Discharge (OTH). The Board disagrees and votes for no misconduct and retention.
