In December of 2019, a 27-year-old plumber, tripped and fell while in the course of his employment at a construction site located in Manhattan. Together with a co-worker, the client had been transporti ... ng an acetylene tank on a hand-truck in the passageway leading to the safety cages where the tank had to be placed. The path was obstructed with equipment and materials. While in the process of removing the obstructions, the client was caused to trip over a metal form and fell, landing with the right side of his body striking the concrete ground. He injured his right knee and his right shoulder. The client was diagnosed with soft tissue injuries and a micro trabecular fracture to his right knee, for which he underwent meniscectomy surgery. Plaintiff also sustained a partial-thickness tear of the supra and infraspinatus tendon (SLAP) of his right shoulder, for which he did not undergo a surgery. I claimed that the defendants violated Labor Law Section 241(6) due to the type of tripping hazard that is protected under Industrial Code (12 NYCRR) Section 23–1.7(e)(1)(2). The defendants argued that Industrial Code section (12 NYCRR) Section 23–1.7(e)(1)(2) did not apply because the area where the client tripped and fell was not a passageway and that the materials over which he tripped were an integral part of the work performed at that location. The case settled for $2,700,000 before motions for summary judgment were submitted.
