It sounds like you in fact went to criminal court and plead guilty though its unclear what you plead to. You should speak to your attorney right...

He can be charged with murder, under an acting in concert theory.

They can charge him if there is evidence that links him to the paraphernalia. For example, if someone saw him put the pipe there....
