The types of matters he handles include patent, copyright, trade secret and trademark cases, as well as other kinds of business litigation involving antitrust, contract, fraud, and other business torts. He has significant experience in a variety of industries including: life sciences; media, entertainment and information; consumer electronics; and the retail sector. His work also involves monetization of IP portfolios.
David's work in the Life Sciences Industries includes the trial of patent, trade secret and business matters, including Hatch-Waxman patent infringement actions. David has written articles and given presentations in the life sciences area, including on the use of ADR in life sciences intellectual property and commercial disputes, and concerning litigation issues arising from poor due diligence in life sciences transactions.
In the Media, Entertainment and Information Industries, David has tried or otherwise resolved cases for performing rights organizations, publishers, technology companies, authors, artists and other creative people and entities involving copyright, trademark, contract, business tort, profit participation, and other matters. He frequently lectures and writes on issues impacting these industries. David also serves as the Chairman of the Board of Directors of Volunteer Lawyers for the Arts.
Among other recognition, David was named a New York Super Lawyer every year from 2010-2016 for Intellectual Property Litigation.
